LONDON. August 15, 2008/3mnewswire.org/ -- The Health and Safety Executive (HSE) has warned activity centres to ensure their staff are properly trained, after a child was seriously injured on a school trip.
Kingswood Learning and Leisure (Group) Limited of Alkmaar Way in Norwich, was fined £12,000 with £10,690 costs at Cromer Magistrates Court today (Aug 15), after pleading guilty to breaching section 3(1) of the Health & Safety at Work etc. Act 1974.
The prosecution follows a HSE investigation into an incident on 28 April 2007, when eight-year-old Mickey Carter-Browne, from Silsoe, was injured during a school trip to the Kingswood Activity Centre at West Runton. He fell six metres from a climbing wall, sustaining a broken ankle and bruising to his pelvis, upper leg, left ankle and arms.
HSE Inspector Steve Gill said: "This was an unfortunate incident which could have been prevented had the correct safety procedures been followed and the staff undertaking the activities properly trained and supervised. Instead, a child was injured and spent ten weeks in plaster, largely confined to a wheelchair, and another ten weeks on crutches.
"It is important to remember that the adventure activities sector as a whole has almost always demonstrated good practices in risk assessment and management, allowing activities to take place safely and enjoyably.
"HSE firmly believes that children must have the opportunity to participate in adventurous activities such as climbing, which are fun, healthy and provide experience and education in risk management. Statistically, one incident does not alter the good track record of an overall safe and well-managed sector."
The incident occurred when Mickey reached a height of about six metres on the climbing wall. A click was heard and he fell onto the wooden floor below.
The HSE investigation identified that when the karabiner (metal loop) was attached to the harness, the screw had not been tightened, which allowed the karabiner to open when a load was applied. The investigation also found that the training and supervision procedures at the centre were not sufficient for the activities being carried out, and were not being routinely followed on the ground.

Harford County's State Attorney Joe Cassilly dismissed the charges earlier this week against eight adults and ten teenagers, who had been arrested without warning during a peaceful public pro-life testimony in Bel Air, Maryland, during the last stop on a tour sponsored by Defend Life.
While none of those taken into custody were told why they were being arrested, they were later charged with loitering, failure to obey a lawful order, and disorderly conduct.
"This decision by the State of Maryland to drop the charges shows that our side of the story was the true story," said Defend Life Director Jack Ames, who was among those arrested. "There were no traffic jams. There were no people running in and out of traffic. There was no refusal to disperse. They plainly and simply violated our First Amendment rights!"

Which Direction is He Leading?

At Saturday's presidential candidates' forum--the first joint appearance of Barack Obama and John McCain in the 2008 campaign--the most interesting man on stage may be neither of the two candidates. It may be Rick Warren, the megachurch pastor and author of the best-selling Purpose-Driven Life. Warren will be asking all the questions in back-to-back hour-long interviews with Obama and McCain, telecast nationally from the pastor's 23,000-member Saddleback Church in southern California.
Obama's and McCain's agendas are clear enough. They want to be the next president. And they want the votes of evangelical Protestants who look up to Warren, without losing the votes of other Americans less comfortable with his evangelical message. The two candidates will affirm religious and moral values, without getting too specific about the content of those values.
But what is Warren's agenda? The megachurch pastor casts himself as a statesman pointing both the evangelical movement and the broader society in more constructive directions. His press release expresses hope that the forum will advance two "life goals" of "helping the Church regain credibility and encouraging our society to return to civility."
Warren intends to focus on "the decision capacity and process of each man" and not so much on their positions on issues. He wants to avoid "the partisan 'gotcha' questions that typically produce heat instead of light." He prefers to talk about "pressing issues that are bridging divides in our nation, such as poverty, HIV/AIDS, climate and human rights."
Here's the subtext: Rick Warren is among some elite evangelical leaders who have decided that their movement has lost credibility through its identification with the Republican Party. They also worry that it has alienated large segments of the public through its strong opposition to abortion and homosexuality.
Warren's solution is to demonstrate that evangelicals are open to Democratic candidates like Barack Obama, that they are interested in ostensibly liberal causes such as fighting poverty and stopping climate change, and that they can speak in a gentle and inoffensive manner.
This strategy makes some sense. Evangelicals care above all about evangelizing the unchurched. And "seeker-sensitive" pastors like Warren realize that the largest number of unchurched Americans lean in a liberal and Democratic direction. They do not want to scare off potential converts by seeming too conservative and Republican.
Besides, there are good reasons in principle to avoid aligning the church with a single political party. The Republican Party is not a Christian organization, and its principles are not identical with the Gospel. Christians have often been embarrassed when political parties they supported turned out to be corrupt and cynical.
Rick Warren will not endorse either candidate. Nor has he abandoned his convictions about abortion and homosexuality. But he does Obama a great favor simply by presenting him on the stage of Saddleback Church alongside John McCain. Assiduously avoiding the issues where evangelicals differ most sharply with Obama also aids the Democrat's cause. (One wonders whether it will be possible, at an event in California, to pretend that the court-imposed redefinition of marriage is a matter of little concern to evangelicals.)
The big question is whether evangelicals in the pews will follow the elite's wish that they split their votes more evenly between Republicans and Democrats. The most recent poll by the Pew Forum for the People & the Press shows McCain leading Obama among white evangelicals by 68 percent to 24 percent-- almost identical to the advantage enjoyed by George W. Bush at the same point in 2004.
Pew research indicates that 61 percent of weekly churchgoing evangelicals label themselves as "conservative." Although abortion and homosexuality are the issues on which their moral principles set them farthest apart from the general public, their conservative instincts run through many other issues. Evangelicals are more likely than others to be suspicious of "big government," skeptical about global warming, and supportive of U.S. military force.
These results raise the possibility of a growing gap between Warrenesque evangelical elites (seeking the political center) and average churchgoers (still quite conservative). We have seen this pattern before: in the declining mainline Protestant churches of the 20th century, where the leadership moved left in a vain attempt to prove its "relevance" to scoffing secularists, thereby leaving far behind its own moderate-to- conservative church membership. This pattern, if repeated, would not bode well for evangelical churches in the 21st century.

August 13, 2008/3mnewswire.org/ -- At just after six o'clock this morning Brixham Coastguard received a call from Devon and Cornwall Police reporting that a concerned wife had just been in touch with them to say that her husband and son had been out on a late night fishing trip and had not returned home.
The pair, who had left St. Austell in South Cornwall on Monday evening in a 6 foot inflatable dinghy, were expected to return to shore at around midnight but had not arrived.
Brixham Coastguard called Mevagissey Coastguard Rescue Team to the scene and requested the launch of Fowey RNLI Inshore and All Weather Lifeboats. Police also attended.
At twenty to eight this morning, the inflatable and the two casualties were located by Mevagissey Coastguard Rescue Team on an inaccessible beach near Gorran Haven where they had been for most of the night. The two men were recovered by Fowey Inshore Lifeboat and transferred to the waiting ambulance where they were treated for hypothermia.
Brixham Coastguard Watch Manager Zoe Boyne said:
"The two men are being treated for the effects of hypothermia but are otherwise safe and well.
After talking to the two casualties it transpires that they suffered engine failure during their trip and began to drift ashore. They then managed to restart the engine and continue their trip, but the strong winds last night upturned the inflatable and left them in the water. They managed to swim safely to an inaccessible beach where they were trapped overnight. These gentlemen are extremely lucky to be alive after a cold and wet night on the beach.

In the discussion, several Experts stressed the importance of not wasting the work that had already been done. However, a decision from the Human Rights Council was needed to clarify which studies could be continued. An Expert said specific proposals should be made to the Council on which studies should be continued, and this should be a one-by-one decision.

Discussion on Studies Prepared by the Sub-Commission on the Promotion and Protection of Human Rights
EMMANUEL DECAUX, Advisory Committee Expert, said that the legacy of the Sub-Commission on the Promotion and Protection of Human Rights was an issue that was both important and complicated. There used to be a degree of creativity in the Sub-Commission which had allowed the Human Rights Commission to detect emerging problems.
Mr. Decaux said the Advisory Committee had to select the issues on which it would work. This could happen in a private meeting. There were different ways to approach the workload. For example, the Committee could continue this system and ask the Council to confirm that the Committee should continue the studies. A different approach would be to ask the Council to confirm a certain number of studies. The Committee would then create teams to carry out these studies. As a third option, one of the Members of the Advisory Committee could prepare a paper for the next session identifying the way on how to carry on and stating how the Advisory Committee could produce added value. The paper would identify the priorities to the Advisory Committee.
Mr. Decaux listed the ongoing studies and reports submitted or mandated for submission by Special Rapporteurs to the Sub-Commission in 2006 in accordance with existing legislative authority:
· Progress report on discrimination in the criminal justice system (E/CN.4/Sub.2/2005/7)
· Preliminary report on the difficulties of establishing guilt and/or responsibility wit regard to crimes of sexual violence (A/HRC/Sub.1/58/CRP.9)
· Second progress report on corruption and its impact on full enjoyment of human rights (A/HRC/Sub.1/58/CRP.10)
· Preliminary report on non-discrimination as enshrined in Article 2, paragraph 2, of the International Covenant on Economic, Social and Cultural Rights (E/CN.4/Sub.2/2005/19 and Corr.1 and 2)
· Progress report on discrimination based on work and descent (A/HRC/Sub.1/58/CRP.2)

VLADIMIR KARTASHKIN, Advisory Committee Expert, said that these issues were quite complicated from a practical and legal point of view. The submitted list of documents did not show very important points. It did not list what the decisions of the Sub-Commission had been on each of the documents that were on hold. The Secretariat should give an update about which documents had been received by the Secretariat and had not been published. He further thought that they legally had no right to continue this work. The former members of the Sub-Commission could not be forced to continue this work, and the Advisory Committee did not have the right to take decisions. There was only one way out: they could prepare a list of important themes, on the basis of the presented document of topics they found important to further develop inside the Advisory Committee. They could also ask the Council to entrust them with the continuation of the studies, this was the only thing they could do. If there was someone volunteering to tackle one of the issues, this could also be possible.
CHUNG CHINSUNG, Advisory Committee Expert, said that there was only one report that the Secretariat had received after 2006. She introduced the issue of discrimination based on work and descent which was discussed at the Sub-Commission on the Promotion and Protection of Human Rights for several years. In 2004, the Sub-Commission appointed Mr. Yozo Yokota and Ms. Chinsung Chung as Special Rapporteurs with the task of preparing a comprehensive study on the subject. In the following years, two reports had been submitted by the Special Rapporteurs. Ms. Chung appealed to the Advisory Committee to submit a proposal to the Human Rights Council to approve this report and consequently to provide a relevant framework for these principles and guidelines to be used to effectively fight discrimination based on work and descent.
EMMANUEL DECAUX, Advisory Committee Expert, wanted to clarify some points: he had never suggested that they continue work on the substance of these studies without receiving the green light from the Council. They needed to have the agreement of the Council first and had to discuss with it what to do. They also had to look into the follow-up of other bodies on each study. ERIC TISTOUNET, Secretary of the Human Rights Council, said that the Council as part of its mandate had been told to finish all studies within one year of its creation. This meant that studies should have been completed in June 2007. The Sub-Commission had convened its final meeting, preparing a paper giving its own vision on future expert advice and describing all its ongoing studies. The Council then adopted a resolution in which it took note of the views of the Sub-Commission on the ongoing activities. Mr. Tistounet clarified that in order for any action to be undertaken a decision from the Council was needed.
VLADIMIR KARTASHKIN, Advisory Committee Expert, said that they had just received another document, but this one was also incomplete. Some working papers sent by former Sub-Commission members were not reflected in the new document. He himself had submitted a document which had not been issued. He thus was not fully satisfied by Mr. Tistounet's explanation.

The Committee had to avoid this waste and the studies should be made available for research and debate on human rights issues. The Committee should propose to the Council in September that these studies should be completed.
MIGUEL ALFONSO MARTINEZ, Advisory Committee President, suggested that Mr. Ziegler draft his ideas as soon as possible, since they had to be submitted to the Secretariat today.
CHEN SHIQIU, Advisory Committee Expert, said that the issue was quite complex. In the past there had been quite a lot of studies. Many of the members who prepared the studies were not part of the Advisory Committee. Some reports were almost finished; some were practically just at the beginning. How should they choose which studies should be continued and which not? If the Committee agreed, they could propose to the Council to make the decision whether one specific study should be continued or not, if one member proposed one study, just like Ms. Chung did.
Mr. Chen said that specific proposals should be made on which studies should be continued. They should not take a decision on all papers. This should be a one-by-one decision. They could still come back at the list in a few years. They did not need to make a decision at this session for all studies. Further, if the authors of some studies were no longer members of the Advisory Committee, an issue to decide on was whether it was permissible to continue the study started by someone else.
CHUNG CHINSUNG, Advisory Committee Expert, wanted to clarify that she did not want a continuation of the study she mentioned earlier. The final report had already been submitted. This paper should be treated in a special way since it had already been submitted.
ALEXANDER PETROV (Russian Federation) said that he heard many times that the Advisory Committee was a successor body to the Sub-Commission, but one should not forget that it was also a new body with a new role. The follow-up of Sub-Commission studies could only happen through the approval of the Human Rights Council. Some of the speakers were right in saying that the Advisory Committee had currently no mandate to continue the studies of the Sub-Commission. Russia, as a member of the Council, had always suggested and supported that the experience and potential of the Sub-Commission should not be lost during the transition period. The Council should take a relevant decision in this regard.
MUSTAFIZUR RAHMAN (Bangladesh) said that there seemed to be a general agreement. A decision had to be taken by the Council on the pending studies. A list had to be prepared in view of the priority and timeliness of the ongoing studies.

If their decisions were all taken in plenary there was no need for regional representation inside groups. Further, he did not think that it was a difficult task to adopt rules of procedure. Also, the impression that the more people were on board of such a group, the better the work would be, was a false impression in his view. Rules of procedure could be done by one person and then be discussed by the plenary. If people found this task too difficult, he could do this work by himself and come up with a proposal at the next session.

MIGUEL ALFONSO MARTINEZ, Advisory Committee President, suggested that Mr. Ziegler draft his ideas as soon as possible, since they had to be submitted to the Secretariat today.
CHEN SHIQIU, Advisory Committee Expert, said that the issue was quite complex. In the past there had been quite a lot of studies. Many of the members who prepared the studies were not part of the Advisory Committee. Some reports were almost finished; some were practically just at the beginning. How should they choose which studies should be continued and which not? If the Committee agreed, they could propose to the Council to make the decision whether one specific study should be continued or not, if one member proposed one study, just like Ms. Chung did.
Mr. Chen said that specific proposals should be made on which studies should be continued. They should not take a decision on all papers. This should be a one-by-one decision. They could still come back at the list in a few years. They did not need to make a decision at this session for all studies. Further, if the authors of some studies were no longer members of the Advisory Committee, an issue to decide on was whether it was permissible to continue the study started by someone else.
CHUNG CHINSUNG, Advisory Committee Expert, wanted to clarify that she did not want a continuation of the study she mentioned earlier. The final report had already been submitted. This paper should be treated in a special way since it had already been submitted.
ALEXANDER PETROV (Russian Federation) said that he heard many times that the Advisory Committee was a successor body to the Sub-Commission, but one should not forget that it was also a new body with a new role. The follow-up of Sub-Commission studies could only happen through the approval of the Human Rights Council. Some of the speakers were right in saying that the Advisory Committee had currently no mandate to continue the studies of the Sub-Commission. Russia, as a member of the Council, had always suggested and supported that the experience and potential of the Sub-Commission should not be lost during the transition period. The Council should take a relevant decision in this regard.
MUSTAFIZUR RAHMAN (Bangladesh) said that there seemed to be a general agreement. A decision had to be taken by the Council on the pending studies. A list had to be prepared in view of the priority and timeliness of the ongoing studies.

Also, the impression that the more people were on board of such a group, the better the work would be, was a false impression in his view. Rules of procedure could be done by one person and then be discussed by the plenary. If people found this task too difficult, he could do this work by himself and come up with a proposal at the next session.

The Committee should consider asking the Council to give the mandate to the Committee to continue those studies to ensure implementation of the rights of indigenous peoples.

However, General Assembly resolution 60/251, which required the Council to review, improve and rationalize all mandates of the Commission, and Human Rights Council Decision 1/102 confirmed that the Council had to also review the work of the Sub-Commission. In order for the Council to carry out this review and determine what to do with the Sub-Commission's work, it first required up-to-date information on the current status of the studies and degree of work that had been done on each. The Advisory Committee was urged to provide an updated list of the current status of the studies. Further, the status of studies varied; some were considered complete by the Sub-Commission, while others were a work in progress. Berlin. (red). 13. August 2008. Die Bundesregierung will die Bundeswehr-Einsätze bei den beiden Friedensmissionen Unmis und Unamid im Sudan fortsetzen. Beide Mandate sollen bis zum 15. August 2009 verlängert werden. Der Bundestag wird voraussichtlich Mitte September darüber entscheiden.
Derzeit sind 39 Soldaten bei der Mission Unmis (United Nations Mission im Sudan) im Einsatz. Sie sind dort als Militärbeobachter und als Personal in Stäben eingesetzt. Damit leisten sie einen wichtigen Beitrag zur Überwindung des Konfliktes im Süden des Landes. Die Mandatsobergrenze liegt bei 75 Soldaten.
Die Regierung Sudans und die südsudanesische Volksbefreiungsbewegung unterzeichneten am 9. Januar 2005 in Nairobi einen Friedensvertrag und beendeten damit die kriegerischen Auseinandersetzungen im Südsudan. Der Konflikt zählt zu den längsten und blutigsten Auseinandersetzungen auf dem afrikanischen Kontinent.
Unmis hat den Auftrag die ehemaligen Konfliktparteien bei der Umsetzung des Friedensabkommens von 2005 zu unterstützen. Gleichzeitig soll der politische und wirtschaftliche Wiederaufbau des Landes forciert werden.

Gegenstand der Abstimmung war ein am 1. August nach vier Tagen Streik erzieltes Ergebnis, wonach die Einkommen der Beschäftigten am Boden ab dem 1. Juli 2008 um 5,1 Prozent sowie ab dem 1. In Croft v. Governor of Texas, two parents in Texas sued the Governor on behalf of their children claiming that merely giving students the option to "pray" is a violation of the Establishment Clause.

The Foundation explains in its amicus brief in Croft that the Establishment Clause only prohibits laws "respecting an establishment of religion." In this case, Texas Educ. Code § 25.082(d) only gives the option to pray during the moment of silence. No student is forced to pray, told how to pray, or told to whom he or she must pray. A student is only required to be silent for 60 seconds. Such a law does not legally establish anyone's duties to God and the manner of performing those duties. In fact, allowing for such freedom of religion is exactly what the First Amendment was intended to protect.
Since the lower court in this case upheld the Texas moment of silence statute (see opinion here), the Foundation urges the U.S. Court of Appeals for the 5th Circuit to affirm the lower court but to do so because the statute does not violate the words of the Establishment Clause: it is not a "law respecting an establishment of religion."

Bereits am Montag hatte die Bundesregierung eine Million Euro für humanitäre Hilfsmaßnahmen zur Verfügung gestellt. Finanziert werden damit Notunterkünfte, medizinische Notversorgung sowie weitere Hilfsgüter für die aus dem Krisengebiet geflohenen Menschen.
Dauerhafte Feuerpause angestrebt
Am Dienstag hatten Russland und Georgien einem Friedensplan zugestimmt, der von der französischen EU-Präsidentschaft vermittelt wurde. Der vereinbarte "Sechs-Punkte-Plan" sei aber noch kein verbindliches Abkommen, stellte Steg fest. Vielmehr müsse aus diesem Plan erst eine verbindliche Regelung entwickelt werden.

Pennsylvania Supreme Court Rules that Homosexual 'Hate Crimes' Law Used Against Christian Evangelists Violates Pennsylvania Constitution
WASHINGTON, July 24 /Christian Newswire/ -- Former Alabama Chief Justice Roy Moore and attorneys with the Foundation for Moral Law applauded the Pennsylvania Supreme Court for its ruling yesterday in Marcavage v. Rendell affirming that the state legislature violated the Pennsylvania Constitution when it added "sexual orientation" and "gender identity" to Pennsylvania's "ethnic intimidation" law (18 Pa. C.S. § 2710) in 2002.
The Foundation, along with attorney Aaron D. Martin, represented Christian evangelists Michael Marcavage, Mark Diener, Randall and Linda Beckman, Susan Startzell, Arlene Elshinnawy, and Nancy Major, who in 2004 were arrested and charged under the "ethnic intimidation" law for evangelizing at a Philadelphia homosexual parade. The Christian evangelists sued and the Commonwealth Court of Pennsylvania agreed that the law was unconstitutional and struck it down. On appeal the Supreme Court of Pennsylvania, in a short per curiam order, agreed with the Commonwealth Court's opinion and the Christian evangelists' appellate brief filed by the Foundation.
Judge Roy Moore remarked on this historic case:
"We are very happy that the Pennsylvania Supreme Court has ruled in our favor to stop the Governor and a group of corrupt politicians from sneaking a 'hate crimes' bill through the Pennsylvania legislature. Preaching to homosexuals about the sin of sodomy should not be made a 'thought crime' in Pennsylvania or any other state."
In the appellate brief filed March 17, 2008, the Foundation and attorney Martin argued to the Pennsylvania Supreme Court that the legislature's altering of an "agricultural crop destruction" bill into an amendment to the "ethnic intimidation" law--making crimes motivated by "sexual orientation," "gender identity" and other classes subject to greater punishment (Act No. 2002-143, HB 1493)--violated, among other provisions, Article III, Section 1 of the Pennsylvania Constitution: "No law shall be passed except by bill, and no bill shall be so altered or amended, on its passage through either House, as to change its original purpose." The Commonwealth Court agreed that the "ethnic intimidation" amendment violated Section 1 and now so has the Pennsylvania Supreme Court.

South Dakota Remains First Abortion-Free State after Planned Parenthood Abortionists Refuse to Work

SIOUX FALLS, SD, July 24 /Christian Newswire/ -- On Monday, July 21, eight women arrived at the Planned Parenthood office in Sioux Falls abortions but were instead met with locked doors and a hand-written not indicating the only abortion clinic in South Dakota was closed.
Planned Parenthood remains closed for abortions after their abortionists, who are flown in from other states, refused of work under the new law that went into effect last Friday. The law orders abortionists to inform patients of the humanity of their babies and that the procedure could affect their mental health two hours before the abortion can be done. The law also provides that abortionists can be sued if they do not comply.
This law was the brain-child of attorney Harold Cassidy and passed with the help of determined pro- life leaders Dr. Alan and Leslee Unruh, who pushed for the regulation in the face of opposition even from those in the pro-life movement. The Eighth U.S. Circuit Court of Appeals cleared the way for the law's enactment last week.
In remains unclear if the Planned Parenthood office has permanently ceased the practice of abortion. However, several women who were scheduled for abortions this week went to a pro-life center instead where some have reportedly changed their minds about having abortions.
