U.S. Appeals Court Decision Acknowledges Humanity of Unborn Child

MEDIA ADVISORY, July 3 /Christian Newswire/ -- Vision America Action President Dr. Rick Scarborough today hailed a decision of the U.S. Court of Appeals for the 8th Circuit acknowledging the humanity of the unborn child.


The 7-4 decision in Planned Parenthood v. Rounds upholds a South Dakota law requiring abortionists to notify women seeking an abortion in writing that "abortion will terminate the life of a whole, separate, unique, living human being."

The Court held that in order to challenge the statute, Planned Parenthood would have to prove the statement false, misleading or irrelevant.

"In fact, it offered no such evidence, because it couldn't - because none exists" Scarborough stated. "Fetal development isn't a matter of opinion or conjecture; it is scientific fact," Scarborough declared.

The Vision America Action president observed: "By the 3rd week, the unborn child's heart begins to beat with its own blood. Its blood-type is often different than its mother's. By the 5th week, its hands, legs and eyes all begin to develop. By the 6th week, brain waves are detectable. By the 7th week, toes and eyelids form, the nose is distinct and the baby begins kicking. And in the 8th week - well inside the first trimester when most abortions take place - every organ is in place."

"It takes a willful act of ideological blindness to deny the reality of the unborn child's humanity," Scarborough continued. "The 8th Circuit Appeals Court said it's perfectly reasonable and constitutional for South Dakota to require abortionists to disclose that reality to pregnant women. Equally important, Planned Parenthood v. Rounds marks the first time a U.S. Appeals Court has gone this far in recognizing the humanity of the unborn child."

Scarborough called the decision, "a major step in making abortion history." He noted that South Dakota will have an amendment on the November ballot banning all abortions in the state except to save the mother's life, or in the exceedingly rare cases of rape or incest.
